Protecting your private information is 340B Technologies, Inc., dba Nuvem, its affiliates and subsidiaries (collectively, "NuvemRx", "we", "us", or "our") priority. This Privacy Policy ("Privacy Policy") describes the way we collect, use, disclose, and retain the information we learn about you from your interactions with us, including but not limited to your visits to our website at NuvemRx.com as well as other NuvemRx properties where the Privacy Policy is included (collectively, the "Site"). Please note that this Privacy Policy does not apply to personal information we obtain in our capacity as an employer.
PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you provide us with your information, including by accessing or using the Site, you consent to the data practices described in this Privacy Policy.
1. Information We Collect
a. Collection of your Personal Information
NuvemRx may collect personally identifiable information, such as:
- Identifiers: First and last name, mailing address, unique personal identifier, online identifier, Internet Protocol
("IP") address, email address, username, and password; - Categories Listed in the California Customer Records Statute: First and last name, mailing address, phone number;
- Internet or Other Electronic Network Activity Information: IP address, browser type, domain names, access times, referring website addresses, user login/logout, interaction with the Site (e.g., pages and features accessed), approximate geographic location, and other technical information such as protocol status and substatus, bytes sent and received, and server information;
- Geolocation Data: Approximate geographic location;
- Professional or employment-related information: Employer, job title; or
- Miscellaneous: Any other information you may share when you contact us.
This information is collected and stored electronically when you contact us or use or access our Site, including registering an account with us through our Site, or complete a survey, including to win a prize by completing the survey.
Where permitted by applicable law, we may combine your personal information with other information we have collected from you. We may also combine your personal information with information we receive about you from other sources, such as our service providers, website analytics and digital advertising vendors, and publicly available information.
b. Automatically Collected Information
Information about your device's hardware and software may be automatically collected by NuvemRx. This information can include: your IP address, browser type, domain names, access times, referring website addresses, user login/logout, interaction with the Site (e.g., pages and features accessed), approximate geographic location, and other technical information such as protocol status and substatus, bytes sent and received, and server information. This information is used for the operation of the Site, to maintain and improve the quality of the Site, for technical troubleshooting, and to provide general statistics regarding use of the Site.
We may also receive similar data from our website analytics and digital advertising vendors.
Use of Cookies and Other Tracking Technologies
The Site may use "cookies". A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. We may use "session cookies" or "persistent cookies." Session cookies are temporary and expire once you close your browser or once your session ends. Persistent cookies remain on your device for much longer or until you or your browser erase them. Persistent cookies have varying durations that are dependent on their expiration date.
We may also use third-party cookies, like Google Analytics, for example, which sets cookies on the Site to help analyze how visitors use the Site. A pixel or web beacon is an HTML code snippet embedded in a website or email that collects information about user behaviors and interactions with the website or email.
We may utilize pixels/web beacons both on certain aspects of the Site and in HTML-formatted email messages to you. Pixels/web beacons may be used for the purpose of, among other things, measuring the success of our marketing campaigns, compiling statistics about Site usage, and tracking the activities of users of the Site and email recipients (e.g., whether an email has been opened). Please note that information collected via pixels/web beacons may be shared with our website analytics and digital advertising vendors.
2. Interest Based Advertising
We may collect information about your online activities on our Site to provide you with advertising about products tailored to your individual interests. We also may obtain information for this purpose from third-party websites on which our advertisements are served.
You may see certain advertisements on other websites because we work with advertising partners (including advertising networks) to engage in remarketing and retargeting activities. Our advertising partners allow us to target our messaging to users through demographic, interest-based and contextual means. These partners track your online activities over time and across websites, including our Site, by collecting information through automated means, including through the use of third-party cookies, web server logs and pixels/web beacons, including the pixels/web beacons that we may utilize on the Site and in our HTML-formatted email messages to you. They use this information to show you advertisements that may be tailored to your individual interests. The information our advertising partners may collect includes data about your visits to websites that participate in the relevant advertising networks, such as the pages or advertisements you view and the actions you take on the websites. This data collection takes place both on our Site and on third-party websites that participate in the ad networks. This process also helps us track the effectiveness of our marketing efforts. For example, we utilize certain of our advertising partners’ targeted advertising services to show you our advertisements on other websites based on your prior visits to our Site and other online activity.

Opting-out does not mean that you will stop receiving advertisements from us. It means that you still stop receiving advertisements from us that have been targeted to you based on your visits and browsing activity across websites over time.
3. Use of Your Information
NuvemRx may use the information we collect about you for any of the following purposes:
- To operate and improve the Site and deliver the services you have requested;
- To create and manage your account with us;
- To operate, improve, and personalize the services we offer, and to give each user a more consistent and personalized experience when interacting with us;
- To administer surveys and enable us to provide you with prizes for completing a survey;
- If you sign up for our email list, to send you our newsletters and emails about services or offers that we may provide that we think might be of interest to you;
- To personalize our marketing communications, and to provide you with information about our services that we think may interest you;
- For security, to detect fraud or illegal activities, and for archival and backup purposes in connection with the provision of the Site;
- To respond to your inquiries and communicate with you;
- For our other business purposes, such as data analytics, accounting, auditing and reporting, developing new or improving our products and services, identifying Site usage trends, and determining the effectiveness of our promotional campaigns;
- As we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce this Privacy Policy; (v) to protect our operations; (vi) to protect our rights, privacy, safety or property, and/or that of you or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.
4. Disclosure of Information to Third Parties
NuvemRx may disclose your information as follows:
- With Third Party Service Providers Performing Services on Our Behalf. We disclose your information with our service providers to perform the functions for which we engage them. For example, we may engage third parties to help perform statistical analysis, send you email or postal mail, host the Site or assist us in providing functionality on the Site, and provide data analytics on the Site.
- Through Tracking Technologies. We may share information collected through tracking technologies set on the Site with our website analytics and digital advertising vendors, including but not limited to the cookies we may utilize on the Site and in our HTML-formatted email messages to you as described above.
- For Legal Purposes. We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to: (i) conform to the edicts of the law orcomply with legal process served on NuvemRx or the Site; (ii) enforce the rights and protect and defend the rights or property of NuvemRx and others; (iii) support external auditing, compliance and corporate governance functions; and/or (iv) act under exigent circumstances to protect the personal safety of users of NuvemRx. We may also share your information as required to pursue available remedies or limit damages we may sustain.
- Changes of Control. We reserve the right to transfer or assign the information that we have collected from users in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
We do not disclose your personal information to third parties for those third parties’ direct marketing purposes.
5. Links
The Site may contain links to other sites or online services. Please be aware that we are not responsible for the content or data practices of such other sites or online services. We encourage our users to be aware when they leave our Site and to read the privacy statements of any other site or online service.
6. Your Rights and Choices
If you have an account with us, you can review your personal information by logging into your account and visiting your account profile page. If you would like to delete your personal information, you may do so by sending us an email at privacy@nuvemrx.com. We may not accommodate a request if we believe complying with the request would violate any applicable law or if applicable law permits us not to comply with the request. We may request specific information from you to help us confirm your identity and to make your requested deletions.
If you want to verify or correct your name or phone number associated with your account, you may do so by logging into your account and visiting your account profile page.
b. Opt-out of Emails
You may choose to stop receiving our marketing emails by following the unsubscribe instructions included in such messages (e.g., clicking the unsubscribe button included in the email) or contacting us at privacy@nuvemrx.com.
7. Security of your Personal Information
Nuvem uses reasonable security measures designed to secure your personal information from unauthorized access, use, or disclosure. For instance, NuvemRx uses SSL Protocol.
We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.
8. Children Under Sixteen
NuvemRx does not knowingly collect or maintain personally identifiable information from children under the age of sixteen. No parts of our Site are directed to or designed to attract anyone under the age of sixteen.
9. Do Not Track
Our Site does not currently take any action when it receives a Do Not Track request. Do Not Track is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. 10. Nevada Residents
Under Nevada law, NuvemRx does not sell your personal information. However, if you are a Nevada resident, you may submit a request that we not sell any personal information we have collected about you by contacting us at privacy@nuvemrx.com.
11. California Residents
The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and its implementing regulations (“CCPA”) provides California residents with specific rights regarding their personal information. The below describes such rights and how you may exercise such rights, and our information practices, including the categories of personal information we collect, use, retain, disclose, sell, or share, and how and why we collect, disclose, sell, or share such information.
a. CCPA Rights
Right to Know
You have the right to request that we disclose what personal information we collect, use, disclose, sell, or share. Specifically, you may request that we disclose to you the following:
The categories of personal information we have collected about you. The categories of sources from which the personal information is collected. The business or commercial purpose for collecting, selling, or sharing personal information. The categories of third parties with whom we disclose personal information. The specific pieces of personal information we have collected about you.
You may also request that we disclose to you:
The categories of personal information that we have sold or shared about you and the categories of third parties to whom the personal information was sold or shared, by category or categories of personal information for each third party to whom the personal information was sold or shared. The categories of personal information that we disclosed about you for a business purpose and the categories of persons to whom it was disclosed for a business purpose.
Right to Delete
You have the right to request that we delete any personal information about you which we have collected from you. If it is necessary for us to maintain your personal information for certain purposes, we are not required to comply with your deletion request. If we determine that we will not delete your personal information when you request us to do so, we will inform you and tell you why we are not deleting it.
Right to Opt-Out of Sale or Sharing of Personal Information
You have the right to direct a business that sells or shares personal information about you to third parties not to sell or share your personal information. We do not sell your personal information for monetary consideration. However, we may use tracking technologies such as cookies and pixels/web beacons for analytics and digital advertising purposes. The collection of data through certain tracking technologies for analytics purposes may be considered a “sale” or “sharing” under the CCPA. To opt-out of having your information sold and shared with third parties for this purpose, visit our “Do Not Sell or Share My Personal Information” web page.
The CCPA requires businesses to process opt-out preference signals (“OOPS”), such as global privacy control (“GPC”) signals, which are signals sent by a platform, technology or mechanism, enabled by individuals on their devices or browsers, that communicate the individual’s choice to opt-out of the sale and/or sharing of personal information. To use an OOPS/GPC, you can download an internet browser or a plugin to use on your current internet browser and follow the settings to enable the OOPS/GPC (for example, https://globalprivacycontrol.org/). We have configured the settings of our consent management platform to receive and process GPC signals on our Site.
NuvemRx does not have actual knowledge that it sells or shares personal information about minors under the age of sixteen.
Right to Correct Inaccurate Personal Information
You have the right to direct a business that collects sensitive personal information about you to limit its use of your sensitive personal information (1) to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services; (2) for certain business purposes; and (3) as authorized by the implementing regulations of the CCPA. NuvemRx does not collect sensitive personal information.
No Discrimination
b. How to Submit a Request
To exercise the rights to know, delete and correct described above, you must submit a verifiable request to us. You can do so by calling us at 855-886-8836 or emailing us at privacy@nuvemrx.com.
To submit a verifiable request, you will be asked to provide certain information to help us verify your identity. The information we ask you to provide to initiate a request may differ depending upon the type of request, the type, sensitivity, and value of the personal information that is the subject of the request, and the risk of harm to you that may occur as a result of unauthorized access or deletion, among other factors.
You may designate an authorized agent to make a request on your behalf by providing the agent with signed written permission to do so.
If we cannot verify your identity or authority to make the request, we will not be able to comply with your request. We will inform you if we cannot verify your identity or authority. We will only use personal information provided in a verifiable request to verify the requestor’s identity or authority to make the request.
c. How We Collect, Use, Disclose, Sell and Share Personal Information
Please see Section 1 (Information We Collect) for the categories of personal information we have collected about you in the twelve (12) months prior to the effective date of this Privacy Policy and the sources of such information. Each of the categories are disclosed for a business or commercial purpose as described above in Section 3 (Use of Your Information) to the third parties listed in Section 4 (Disclosure of Information to Third Parties).
We will retain the personal information described above for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulations. The following categories of personal information were sold or shared in the twelve (12) months prior to the effective date of this Privacy Policy:

Such information is sold to or shared with our third-party website analytics vendors.
We share or sell such information:
- To operate and improve the Site and deliver the services you have requested;

- To personalize our marketing communications, and to provide you with information about our services that we think may interest you;

NuvemRx may provide financial incentives, such as a chance for you to win a gift card for completing a survey (“Financial Incentive”). When you participate in a Financial Incentive, we may collect personal information from you, such as identifiers (like your name and email address) and any other information you provide (like feedback on our products and/or services). You may opt-in to the Financial Incentive at any time and participation in the Financial Incentive is completely voluntary. In some cases, we may provide additional terms and conditions for a Financial Incentive, which we will present to you when you sign up. We value your personal information as the value of the offer provided to you, and the value of your personal information is reasonably related to the value of the offer presented to you.
12. Changes to this Statement
NuvemRx reserves the right to change this Privacy Policy from time to time. Your continued use of the Site and/or services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Privacy Policy.
